According to Shariah, verbal utterance is not a necessary condition for the validity of a divorce (talaq). Rather, divorce is also effected by means of the written word.

The great Hanafi jurist, Imam al-Kasani (Allah have mercy on him) states: “Similarly, issuing a divorce verbally is not a condition. Hence, divorce will be effected with clear and unambiguous writing, or with the understood gesture (isharah) of a dumb person, because the clear written word is in place of verbal utterance”. (Bada’i al-Sana’i, 3/100)

It is stated in al-Fatawa al-Hindiyya: “Writing (m: a divorce) is of two types: A formally written letter and informal writing. A formally written letter is that which has a heading and title like that which is written to a non-present person, and non-informal writing is that which does not have a heading. Then, non-formal writing is of two types: Clear and understandable writing and unclear writing. Clear writing is that which is written on a piece of paper, wall or ground in a way that it is understandable and readable, and unclear writing is that which is written in the air, on water or on something in a way that it is not understandable or readable.

2507. * A man who divorces his wife must be adult and sane. Similarly, a man should divorce of his own free will, therefore, if someone compels him to divorce his wife, that divorce will be void. It is also necessary that a man seriously intends to divorce; therefore, if he pronounces the formula of divorce jokingly, the divorce will not be valid.

2517. * It is necessary that the formula of divorce is pronounced in correct Arabic using the word “Taliq”; and two just (’Adil) persons should hear it.

It is necessary in divorce case that husband and wife both are present in front of the authority who has powers to issue decree of divorce. He/She has to first identify both husband and wife, then listen their case and then Judge whether they should be divorced or not.

Without physical presence of both partners, no divorce case can be even heard by the Judge or the Religion Scholar authorize to hear divorce cases.

Muslim authorities in Dubai, acknowledging the synergy of technology and tadition, Thursday confirmed that a Muslim divorce can be carried out via a mobile phone text message or SMS.

The country’s Grand Mufti, Ahmed al-Haddad, who issued a fatwa on the subject, noted: ‘Islamic clerics disagreed over the way divorce can be written.’

‘While some said writing a divorce is equivalent to verbally announcing it, others believe a divorce must be documented by writing and can only be applied when there is intention and when it is read aloud.’

Al-Haddad said he believed an Islamic judge or ‘mufti’ is able judge a divorce case filed via a mobile phone SMS, based on any of the two opinions by choosing what is most applicable to the couple’s circumstances.

‘Divorce through this modern way is not different from using a pen and a paper,’ he said.
In Islam, if a husband seriously and verbally tells his wife ‘you are divorced’, they should be separated even without a formal certification of divorce.

The All India Muslim Women Personal Law Board (AIMWPLB) has released the Shariat Nikahnama that they claim would give equal rights to both Muslim men and women.

The board has also rejected any divorce done through SMS, email, phone as well as video conferencing, besides rejecting divorce done on provocation.

A Muslim woman can seek divorce if she is forced by her husband to indulge in unnatural sex. She can also seek divorce if her husband contracts Aids.

“People use SMS, email and the internet to give talaq in the absence of a witness. Such ways have been banned in the new Nikahnama,” said Shaista Amber, President of the AIMWPLB.

“We have framed the new nikahnama strictly in accordance with the tenets of Islam, which clearly prohibits any kind of harassment or oppression of a married woman by her husband,”
